A hurdle with prosecuting animal sexual assault is learning of the actual offenses, similar to human trafficking, child pornography, or other abusive crimes it requires another person or the victim to actually report the crimes. However, unlike humans, animals cannot tell another person what is happening to them. this crime, like animal cruelty or child abuse, relies more on other people to stand up and speak for them. 

Bestiality is a criminal crime, which requires like any criminal offense requires probable cause to search, investigate, and arrest the offender.

In the crime of bestiality,  the issue is whether or not animals are or can be considered victims when they are defined as property under the law.

Sexual Assault, Bestiality, and Rape are about power and control, however in bestiality it includes the animals welfare as well. Moreover, in the act of bestiality animals cannot consent unlike a child orally, even though it is arguable that a child under the age of consent can actually consent.

Standing

Standing is one of the biggest hurdles that animal advocates face.  Because bestiality is a criminal crime, the state has standing to bring a prosecute the alleged offender.
